Terms and Conditions

1. DEFINITIONS


1.1 Owner means CELEBRRENTS PTY LTD (The Trustee for NextGen Family Trust, ABN 38 589 706 979).
1.2 Hirer means the individual or company that has signed and agreed to these Terms and has hired Equipment from CELEBRRENTS PTY LTD for personal or business use.
1.3 Equipment means all items and accessories supplied by CELEBRRENTS PTY LTD to the Hirer, including but not limited to tools, props, décor, and other event-related items.
1.4 Terms means these Terms and Conditions of Hire.
1.5 Booking means any written booking or order made by the Hirer to CELEBRRENTS PTY LTD for Equipment and/or Services.

2. CONDITIONS OF HIRE


2.1 Unless otherwise agreed in writing, these Terms are the only terms on which the Owner supplies Equipment and/or Services to the Hirer.
2.2 These Terms are accepted by the Hirer upon payment of a booking deposit received by the Owner.
2.3 Hire commences on the start date specified on the invoice or booking agreement and continues for the stated term. Any extension must be agreed with the Owner and may incur additional charges.
2.4 The Hirer must use the Equipment only at locations and for purposes for which it is suitable. The Hirer must not relocate the Equipment from the installed position without the Owner’s consent and must ensure the Equipment is not damaged, lost or stolen during the hire period.
2.5 The Hirer accepts responsibility for the Equipment and is liable for any loss or damage, except for reasonable wear and tear (see Appendix B).
2.6 If the Hirer is collecting Equipment, the Owner will provide set-up and safety instructions (see Appendix A). The Hirer must follow all instructions and ensure all participants and guests are informed of safety requirements. If unsure, the Hirer must contact the Owner for assistance.

3. BOOKING AGREEMENT


To ensure availability, a completed booking agreement must include: the Hirer’s name and contact details; the specific Equipment requested; pick-up/delivery and return/collection dates and times; and the event location (for delivery bookings).

4. HIRE CHARGES & DELIVERY

 

4.1 Prices
All prices exclude delivery and set-up fees unless stated otherwise.

4.2 Standard Hire Period and Timing Changes
The standard hire period is up to three (3) days, with specific pickup/delivery and drop-off/collection times stated on the invoice. Items must be returned at the agreed times. Returning items outside the agreed times—even within the 3-day period—may incur charges under clauses 4.3 and 4.4. Any timing changes must be requested and approved in writing before the scheduled time.

4.3 Owner to Deliver and Collect

  1. Delivery/collection operates 8:00am–11:30pm, seven days a week (including public holidays).

  2. Deliveries/collections outside 8:00am–11:30pm may incur a surcharge. Surcharge amounts may change and are updated periodically on the Owner’s website.

  3. A public holiday surcharge may apply; the amount will be specified on the invoice.

  4. Delivery is to street level where grounds/floors are level and clear. If higher-level delivery is required, the Hirer must notify the Owner before paying the deposit; extra surcharges may apply and are periodically updated on the website.

  5. The Hirer is responsible for confirming the Equipment fits the venue (including ceiling heights, doorways, stair/lift access).

  6. If on arrival the Equipment does not fit or access is unsuitable, the Owner may refuse delivery.

  7. Access and Waiting Fees. If the Owner’s staff or contractors cannot gain access to the venue at the agreed time, a 0–15 minute grace period applies with no charge. From minute 16 onward, a $1 per minute waiting fee applies until access is granted. The maximum wait time is 30 minutes. If access is still unavailable at 30 minutes, the visit will be aborted and a re-delivery fee equal to the initial delivery fee for that booking will apply to return at a later agreed time (subject to availability). Any waiting fees incurred on the initial attendance remain payable in addition to the re-delivery fee.

 

4.4 Hirer to Collect and Return

  1. Covered vehicles only (vans/trucks). Open trailers may be considered only in suitable weather. The Owner may refuse release if a vehicle is unsafe or unsuitable.

  2. Items must be secured with heavy-duty straps to prevent shifting or damage.

  3. Late Pick-Up Clause. A 0–15 minute grace period applies from the agreed pick-up time. From minute 16 onward, a $1 per minute late fee applies until collection is completed. The late fee is waived if the Hirer notifies the Owner and a new pick-up time is mutually agreed (same day or another available day). Notification must be by call, SMS, or email to the contact details in the booking confirmation. All reschedules are subject to availability.

  4. Late Return Clause. A 0–15 minute grace period applies from the agreed return time. From minute 16 onward, a $1 per minute late fee applies until the Equipment is returned and checked in. The late fee is waived if the Hirer notifies the Owner and a new return time is mutually agreed (same day or another available day). Notification must be by call, SMS, or email. The Owner may deduct late fees from the security bond in accordance with these Terms

  5. Non-return and non-contact. If the Equipment is not returned at the agreed time and the Hirer is uncontactable for more than 24 hours, this constitutes a material breach. The Owner may

    1. (i)continue to charge the standard daily hire rate until the Equipment is returned,

    2.  (ii) charge reasonable recovery, attendance costs in accordance with clause 5.4, and

    3. (iii) after 7 days, deem the Equipment lost and invoice the Hirer the full replacement cost .The Owner may engage third-party recovery services and commence civil recovery action.

5. DEPOSIT & PAYMENTS

 

  1. A 50% deposit is required within 24 hours of invoice (unless clause 5.2 applies). Failure to pay makes the requested Equipment available for public hire. Full payment is due no later than 7 days before the event.

  2. If the order is placed less than 7 days before the event, full payment is required within 24 hours of invoice.

  3. Payment must be made by bank transfer to the Owner’s nominated account. The Hirer is responsible for any bank fees.

  4. Recovery Costs (capped). The Hirer agrees to pay the Owner’s reasonable, actually incurred costs of collection and enforcement (for example, third-party debt recovery fees and reasonable legal costs) incurred after the Owner has given the Hirer written notice of default and the default has not been remedied within a reasonable time. Any such amounts must be proportionate to the debt and reasonably necessary to recover it.

6. CANCELLATION AND VARIATIONS


6.1 Hirer cancellations (must be in writing):
• 28–7 days before the hire date: loss of 50% of the total booking cost.
• Less than 7 days before the hire date: loss of 100% of the total booking cost.
At the Owner’s discretion, the Hirer may reschedule to an alternative date subject to availability. Any deposit or payments may be carried forward to the new date.

6.2 Owner unavailability. If the Owner cannot provide the booked goods or services, the Owner will notify the Hirer as soon as possible and offer alternatives (for example, substitutes of equal or higher value, fee adjustment, or cancellation). If the Owner cancels the order (even if previously accepted), the Owner will provide written notice and a full refund of amounts paid for undelivered goods or services.

7. SECURITY BOND


7.1 A security/damage bond (typically $100–$200, depending on items) is payable and held until safe return of all items in the same condition and within the booking period.
7.2 The bond will be refunded after return and inspection. Repair or replacement costs for damage or missing items may be deducted. If costs exceed the bond, the Hirer must pay the balance.

8. OUTDOOR SETUPS, WEATHER AND BACKUP PLAN


8.1 Safety first. The Owner will not proceed where weather or site conditions (such as heavy rain, strong winds, lightning, or extreme heat) make delivery, installation or operation unsafe, non-compliant or reasonably impracticable.
8.2 Mandatory backup plan. For any outdoor setup, the Hirer must provide a written backup plan (for example, relocation to a suitable indoor or fully sheltered area)

8.3 Activation and no viable backup. If conditions require, the Owner may require activation of the backup plan. If no viable backup plan is provided or cannot be implemented when required, the Owner will not proceed with the booking and the booking is treated as a Hirer-initiated cancellation at that time; the Cancellation Policy applies. The Owner is not liable for any loss arising from weather or the absence or unavailability of a viable backup plan.

8.4 Care of items outdoors. The Hirer must protect all hired items from weather and exposure risks during the hire period (including rain, wind, excessive sunlight, and other environmental factors). Some items require a minimum of two adults for safe movement and handling; the Hirer must ensure sufficient help. Insufficient help does not absolve liability for damage.

 

9. CLEANING AND PRODUCT HIRE CONDITIONS


9.1 At the end of the hire, the Hirer must return Equipment clean and free of decorations not supplied by the Owner and remove any waste.
9.2 If Equipment is not returned clean, a cleaning fee may be charged and deducted from the bond.
9.3 If vinyl or signage is applied to products, the Hirer must remove it after use. A cleaning/removal fee may apply if not removed.

10. DAMAGE OF EQUIPMENT


10.1 The Hirer must take reasonable precautions to protect Equipment from damage or theft, including storing it in a secure, dry location.
10.2 If damage or loss occurs, the Hirer must notify the Owner immediately and take steps to prevent further loss.
10.3 The Hirer is responsible for repair or replacement costs for damage or loss (except reasonable wear and tear).
10.4 All packaging and tools supplied must be returned in good condition and in the same quantity. Missing or damaged items will be charged to the Hirer.

11. CHILD SUPERVISION REQUIREMENT


Equipment must only be used under the direct supervision of a parent or guardian. The Hirer is responsible for notifying attendees that children must not be left unsupervised while using the Equipment. Continuous oversight by parents or caregivers is required throughout the event.

12. INDEMNITY AND LIABILITY


12.1 Australian Consumer Law (ACL). Nothing in this Agreement excludes, restricts or modifies any consumer guarantee, right or remedy conferred on the Hirer by the Australian Consumer Law or any other law that cannot be excluded, restricted or modified.
12.2 Hirer indemnity (fault-based). To the extent permitted by law, the Hirer indemnifies the Owner against loss, damage, liability, cost or expense (including reasonable legal costs) suffered or incurred by the Owner to the extent caused by:

  1. the Hirer’s breach of this Agreement;

  2. misuse, neglect, alteration or unauthorised transport of the Equipment;

  3. failure to follow the Owner’s written or verbal instructions, safety directions, anchoring or weighting requirements, or venue guidelines;

  4. use of the Equipment at a site that is unsafe, unsuitable or lacks required approvals; or (e) property damage or personal injury caused by the Hirer’s acts or omissions.


12.3 Carve-outs. The indemnity in clause 12.2 does not apply to the extent any loss is caused by the Owner’s negligence, breach of this Agreement, or failure to comply with the ACL.
 

 

 

 

Appendix A : Set up and safety of the equipment.

When setting equipment, it is important to ensure that it is done safely and securely to prevent any accidents or injuries. Here are some specific instructions for safely setting up equipment.

 

Backdrops (Minimum 2 people required to setup)

  1. Choose a flat and stable surface for the background stand. Avoid setting it up on uneven ground or surfaces that can be easily moved,

  2. Check the background stand and all its parts for any damages or defects before use. Do not use if any parts are damaged or missing.

  3. Set up the background stand according to the manufacturer's instructions.

  4. Attach the background to the stand using tapes provided. Be sure to attach it securely to prevent the backdrop from falling. Adjust the height of the stand if necessary.

  5. Once the background is securely attached to the stand, test it by pulling on the panel gently to ensure it is secure and will not fall.

  6. If attaching decal or decorations to the background, ensure that they are securely attached and will not fall or become a hazard to those nearby.

  7. Due to the inclement weather conditions, please take extra precautions when setting up your outdoor equipment. Check weather forecasts regularly and plan accordingly. Avoid setting up equipment during severe weather conditions such as thunderstorms, strong winds, or heavy rain.

 

 

 

Wooden and metal arbors: (Minimum 2 people required to setup)

  1. Choose a level and stable location, make sure the ground is even and free from any obstacles.

  2. Ensure that there are no underground and overhead utilities such as gas or electric lines in the area.

  3. Assemble the arch according to the manufacturer's instructions. Make sure all pieces are securely fastened together and the arch is stable.

  4. To prevent the arch from tipping over or being blown away by the wind, secure it to the ground. You can use metal stakes or anchors to secure the arch. Make sure they are driven deep into the ground and the arch is securely fastened to them. (Sandbags can be placed on the legs of the arch if used indoor)

  5. Once the arch is assembled and secured to the ground, check for stability. Wiggle the arch to make sure it is stable and won't fall over. If it wobbles or seems unstable, adjust the stakes, or anchors as necessary.

  6. If you are attaching decorations to the arch, such as flowers or ribbons, make sure they are securely fastened and won't come loose in the wind. Avoid attaching anything heavy or bulky that could potentially pull the arch over.

  7. Overall, it's important to take your time when setting up an outdoor wooden arch and follow all manufacturer's instructions carefully. Taking the necessary precautions will ensure that the arch is safe and stable for your event.

 

 

Decorations:

  1. Determine the weight of the decorations: Before hanging anything on the wooden or metal arch, determine the weight of the decorations to ensure that the arch can support them.

  2. Use sturdy hooks or cable ties: When attaching decorations to the arch, use sturdy hooks or cable ties that can support the weight of the decorations. Avoid using string or ribbon, which may not be strong enough.

  3. Securely attach the decorations: Make sure that the decorations are securely attached to the hooks or cable ties. Test each decoration to ensure that it will not come loose or fall off.

  4. Avoid overloading the arch: Do not overload the arch with too many decorations or decorations that are too heavy. This can cause the arch to become unstable and potentially collapse.

  5. Check the arch regularly: Check the arch regularly to make sure that all decorations are still securely attached and that the arch is stable. If you notice any issues, take steps to address them immediately.

 

 

By following these instructions, you can help ensuring that your props are safely and securely setup. If you are unsure about how to set up a particular piece of equipment safely, please consult with the Owner.

 

 

 

Appendix B: Fair Wear and Tear

 

Wooden Arches, Metal Arches, Cake Plinths and backdrops

 

Fair Wear and Tear includes:

  • Scratches/Scrapes that are not visible when standing 1.5 metres back from the item: or

  • light scuffing or scratches where there is no paint penetration; or

  • chips and dents up to 2 mm in diameter; or

  • Light scratches and scuffing up to 30 mm in length; or

  • light marks that can be removed by general cleaning or

  • light scuffing or smears or regular day to day debris that is removable by general cleaning.

 

Fair Wear and Tear excludes:

  • More than 3 chips and dents to the item.

  • any damage affecting or penetrating the paintwork.

  • Any scratch where the undercoat is exposed.

  • Multiple scratches of any size on the front side

  • Chips and dents of 2.1 mm or more in diameter.

  • Any permanent damage caused by harsh or corrosive materials.

  • Tears, cuts, scratches, holes, or burns.

  • Any damage to the structure, 

  • Excessive soil, mud or sand (other than from regular day to day use);

  • Odours or foreign matter; stains or marks that cannot be removed by general cleaning or require special cleaning.

  • Damage caused by incorrect fitting of accessories and decals.

  • Removal or damage to any parts supplied with the item

 

Faux Flowers

Fair Wear and Tear includes:

  • Minor signs of use, such as light creases or bends that do not affect the overall appearance of the faux flowers.

  • Light marks or stains that can be removed by wiping with a damp cloth.

  • Natural fading or slight discoloration due to regular use.

  • Missing up to 3 leaves and 1 flower.

  • Broken stems or other parts of the faux flowers that can be glued back.

 

Fair Wear and Tear excludes:

  • Tears, cuts, scratches, or burns.

  • Missing more than 3 leaves and 1 flower

  • Broken stems or other parts of the faux flowers that can’t be repair.

  • Any damage caused by harsh or corrosive materials.

  • Any damage resulting from improper use or storage.

  • Any damage resulting from over exposure to weather or natural elements.
